1. Introduction
These Terms and Conditions (“Agreement”) govern your use of the Ahava Loves website, mobile application, and related services (collectively, the “Services”), operated by Ahava Loves Inc. (“Ahava Loves”, “we”, “us”, or “our”).
By accessing or using the Services, you agree to be bound by this Agreement. If you do not agree, you must not use the Services.
2. Eligibility and Membership
You must be at least 20 years old and legally single (unmarried, divorced, or widowed) to use the Services.
You agree to:
- Provide accurate and truthful information
- Maintain the security of your account
- Be responsible for all activities under your account
We reserve the right to suspend or terminate accounts for violations of this Agreement or applicable laws.
3. User Responsibilities and Conduct
By using the Services, you agree to comply with the following rules:
3.1 Accuracy of Information
You are responsible for the accuracy of all information you provide. Providing false information may result in account termination and legal responsibility.
3.2 User Conduct
You agree that:
- You are responsible for your interactions with other users
- Ahava Loves does not verify or guarantee the accuracy of user content
- You will act respectfully and lawfully when using the Services
3.3 Platform Nature Disclaimer
Ahava Loves provides a communication and matchmaking platform only.
We do not guarantee:
- Matches
- Relationship outcomes
- User behavior
All decisions and interactions are solely your responsibility.
3.4 Content Responsibility
All content exchanged between users is the sole responsibility of the users.
Ahava Loves does not control, endorse, or assume liability for such content.
4. User Content
You retain ownership of your content. However, you grant Ahava Loves a non-exclusive, worldwide, royalty-free license to use your content solely to operate and improve the Services.
We reserve the right to remove content that violates this Agreement.
5. Prohibited Uses
You agree not to use the Services for:
- Any unlawful purpose
- Harassment, abuse, or discrimination
- Providing false or misleading information
- Uploading malicious code
- Spamming or fraudulent activities
We may terminate your access for violations.
6. Billing, Payments, and Refunds
6.1 Payments
You agree to pay all applicable fees. Subscriptions may renew automatically unless canceled.
6.2 Service Delivery
The Services are considered delivered upon providing access to platform features, including account access, browsing, and messaging functions.
6.3 No Guarantee of Results
Payments are made solely for access to platform services and do not guarantee any specific outcomes, including matches or responses. Lack of results does not constitute grounds for a refund.
6.4 Refund Policy
Refunds are subject to our Refund Policy.
- A 3-day free trial may be offered
- Full refund may be available within 24 hours (if not substantially used)
- Partial refunds may be provided on a prorated basis
For Apple In-App purchases, refunds are handled by Apple.
6.5 Chargeback and Disputes
If a chargeback or payment dispute is initiated, we reserve the right to suspend or terminate the associated account and investigate the matter.
7. Intellectual Property
All content, trademarks, and materials on the Services are owned by Ahava Loves or its licensors and are protected by applicable laws.
You may not copy, modify, distribute, or reproduce any content without prior written consent.
8. Privacy
Your use of the Services is also governed by our Privacy Policy.
We collect, use, and protect your personal information in accordance with applicable laws.
9. Limitation of Liability
To the fullest extent permitted by law, Ahava Loves is not liable for:
- Indirect or consequential damages
- Loss of data, profits, or relationships
- User interactions or behavior
Total liability shall not exceed the amount paid by you in the past 12 months.
10. Indemnification
You agree to indemnify and hold Ahava Loves harmless from any claims arising from:
- Your use of the Services
- Your content
- Your violation of this Agreement
11. Account Suspension and Termination
We may suspend or terminate your account for:
- Violation of this Agreement
- Harmful behavior
- Legal requirements
If terminated, you may not re-register.
12. Service Changes
We may modify or discontinue Services at any time.
We may also update these Terms and notify users where appropriate.
13. Governing Law and Dispute Resolution
This Agreement is governed by the laws of Ontario, Canada.
All disputes shall be resolved in the courts of Ontario.
14. Severability
If any provision is found invalid, the remaining provisions remain enforceable.
